Leaseholders Rights to Appeal

On 1st July 2024, we procured and entered into a long-term agreement for our gas servicing contract, as required under the terms of our customers’ lease agreements with us.

On 5 August 2024, we applied to First Tier Tribunal for dispensation from the consultation requirements for qualifying long-term agreements, as defined by Section 20 of the Landlord and Tenant Act 1985 (as amended).

A determination was reached by the Firs-tier Tribunal on the 21st January 2025 details of which are below:

Any appeal against this decision must be made to the Upper Tribunal (Lands Chamber). Prior to making such an appeal the party appealing must apply, in writing, to the Tribunal for permission to appeal within 28 days of the date of issue of this decision (or, if applicable, within 28 days of any decision on a review or application to set aside) identifying the decision to which the appeal relates, stating the grounds on which that party intends to rely in the appeal, and stating the result sought by the party making the application.

You can download the determination document here.
